Indiana AG Rokita files amended lawsuit over Monroe County Sheriff’s immigration policy

BLOOMINGTON — Indiana Attorney General Todd Rokita has filed an amended complaint in the lawsuit against the Monroe County Sheriff’s Office immigration policy, after a judge ruled Rokita’s argument was insufficient.

Rokita filed the lawsuit in Monroe Circuit Court in July, claiming the county is violating state law by "limiting or restricting the enforcement of federal immigration laws."

Marté filed a motion to dismiss the lawsuit in September. In a Dec. 19 ruling, the court ruled Rokita did not fully prove that the policy violates Indiana Law, granting Rokita a chance to amend the lawsuit.

In the new complaint, Rokita argues the policy, MCSO-12 (attached below), violates Indiana law, claiming it prohibits local governments from preventing law enforcement officers to engage with federal immigration officials.

Marté has asked the court for a 30-day extension, until Feb. 28, to file a response to the amended complaint.
