INDIANAPOLIS, Ind. (IUSTV News) – The Indiana Supreme Court Disciplinary Commission has filed a complaint against Indiana Attorney General Todd Rokita for comments he made in 2022 about Dr. Caitlin Bernard, the IU Health OB-GYN who performed an abortion on a 10-year-old rape victim from Ohio.

The charges come less than a week after Attorney General Todd Rokita filed a lawsuit against IU Health for claims they violated patient privacy and HIPAA. 

According to the complaint, Rokita violated three separate rules of conduct when he made public comments about the case and the investigation into Dr. Bernard, which was on-going at the time.

For the first two counts, the complaint cites Rokita’s appearance on the Jesse Waters show on July 13, 2022, where Rokita called Dr. Bernard an “abortion activist acting as a doctor—with a history of failure to report.”

The Indiana Supreme Court Disciplinary Commission says that Rokita violated Indiana Rule of Professional Conduct 3.6(a) and 4.4(a).

The third count of the complaint says that Rokita intentionally made public statements about the case before referring Dr. Bernard to the State Medical Licensing Board.

In May 2023, the board found that Dr. Caitlin Bernard violated patient privacy laws at the state and federal level by speaking to the IndyStar about the case. However, the board shot down a complaint from Rokita that Dr. Bernard failed to report the abortion, which the state says was reported to the Indiana Department of Health on July 2, 2022.

In response to the complaint, the Attorney Generals Office said, “We will continue defending Indiana’s laws and ensure that licensed medical professionals and other healthcare providers are held accountable when they violate their patients’ privacy and fail to obtain consent.”

The case now heads to the Indiana Supreme Court, where no definitive date has been set.
